Welcome to LoveProof.

These Terms & Conditions ("Terms") govern your access to and use of the LoveProof website, waitlist, future mobile application, platform and related products and services (collectively, the "Service"). LoveProof is based in New South Wales, Australia. By accessing our website, joining the LoveProof waitlist, creating an account or using the Service, you agree to these Terms. If you do not agree with these Terms, please do not use LoveProof.

1. About LoveProof

LoveProof is being developed to help people make more informed decisions when interacting with people through online dating platforms.

LoveProof may provide tools including:

• Reverse image searching
• Image-source analysis
• AI-generated image detection
• AI-generated or AI-assisted text detection
• Dating-profile analysis
• Romance scam indicators
• Fake-profile indicators
• Trust Scores™
• Risk indicators
• Other authenticity and safety-related information

LoveProof is an information and decision-support tool.

It is not an identity verification service, private investigation service, background-check service, law enforcement service or guarantee of another person's identity, intentions, honesty or safety.

2. LoveProof Does Not Guarantee Someone Is Genuine

This is important.

LoveProof uses technology, data analysis, artificial intelligence and third-party services to identify potential indicators relating to online profiles.

Technology is not perfect.

LoveProof may produce:

• False positives
• False negatives
• Incomplete results
• Incorrect matches
• Outdated information
• Incorrect AI classifications
• Results affected by insufficient available information

A high Trust Score™ does not guarantee that a person is genuine, trustworthy, honest or safe.

A low Trust Score™, warning or risk indicator does not prove that a person is fraudulent, dishonest, dangerous, fake or engaged in unlawful activity.

LoveProof results should always be considered alongside your own judgement and other available information.

3. AI-Generated Results

Some LoveProof features may use artificial intelligence, machine learning or automated analysis.

AI-generated results are probabilistic assessments rather than statements of fact.

For example, LoveProof may indicate that an image or piece of text has characteristics consistent with AI-generated content.

This does not necessarily mean that the content was created using artificial intelligence.

Similarly, LoveProof's inability to identify AI-generated content does not establish that the content is authentic.

Percentages, scores and confidence ratings displayed by LoveProof should therefore be interpreted as indicators only.

4. Trust Score™

LoveProof may provide an overall Trust Score™, confidence rating, risk score or similar assessment.

These scores may consider multiple signals, including image analysis, text analysis, reverse image search results and other available information.

A Trust Score™ represents LoveProof's automated assessment based on the information available at the time of analysis.

It is not a factual determination about another person. You must not represent a LoveProof Trust Score™ as proof that another individual has committed fraud, engaged in criminal activity, misrepresented themselves or behaved dishonestly.

5. Your Responsibility

You remain responsible for your own decisions when communicating with, meeting or entering into a relationship with another person. LoveProof does not make decisions on your behalf. Before meeting someone you have met online, you should take appropriate precautions and use your own judgement. You should never rely solely on LoveProof when making decisions relating to:

• Personal safety
• Financial transactions
• Sending money
• Sharing sensitive information
• Travel
• Relationships
• Identity verification
• Legal matters

If you believe you are in immediate danger, contact the appropriate emergency services.

6. Eligibility

You must be at least 18 years old to use LoveProof. By creating an account, joining our waitlist or using the Service, you confirm that you are at least 18 years of age.

7. Information You Upload

LoveProof may allow you to upload or submit:

• Dating-profile screenshots
• Photographs
• Profile biographies
• Usernames
• Written conversations
• Profile information
• Other content

You are responsible for ensuring that you are legally permitted to provide and use information submitted to LoveProof.

You should only submit information reasonably necessary for the purpose of assessing an online dating profile.

Do not upload unnecessary private, confidential or sensitive information.

8. Acceptable Use

LoveProof is intended to help users make safer and more informed decisions about online interactions.

You must not use LoveProof to:

• Harass another person
• Stalk another person
• Threaten or intimidate someone
• Discriminate unlawfully
• Defame another person
• Conduct unlawful surveillance
• Obtain information for an unlawful purpose
• Publicly shame another person
• Publish LoveProof results as factual allegations about another person
• Impersonate another person
• Circumvent security controls
• Attempt to access another user's account
• Scrape or systematically extract LoveProof data
• Reverse engineer the Service except where permitted by law
• Interfere with LoveProof's systems
• Use automated tools to abuse the Service
• Use LoveProof for any illegal or unauthorised purpose

We may suspend or terminate access where we reasonably believe the Service is being misused.

9. Third-Party Dating Platforms

LoveProof is an independent service. Unless expressly stated otherwise, LoveProof is not affiliated with, endorsed by or sponsored by any dating application, social network or other third-party platform. References to third-party platforms are provided only to describe compatibility or potential use cases. Third-party names, trademarks and logos remain the property of their respective owners.

10. Third-Party Information and Services

LoveProof may rely on third-party services, databases, search technologies, artificial intelligence providers and publicly available information.

We do not control all third-party information or services.

Third-party information may be incomplete, unavailable, inaccurate or outdated.

LoveProof does not guarantee the availability, accuracy or completeness of information obtained from third-party sources.

11. Waitlist and Founding Members

LoveProof may operate a pre-launch waitlist and Founding Member program.

Joining the waitlist does not guarantee:

• A particular launch date
• Access to every future feature
• Permanent access to LoveProof
• Availability in your country
• Acceptance into a limited beta program

We may modify development timelines, features and launch plans as the product evolves.

12. Founding Member – 3 Months Free

Eligible Founding Members who complete the required registration and survey may receive:

3 months of Unlimited Premium access when LoveProof launches.

Eligibility requirements and redemption instructions may be communicated separately.

The promotional entitlement:

• Has no cash value
• Cannot be exchanged for cash
• May not be sold
• May not be transferred unless LoveProof expressly permits it
• Must be redeemed using the applicable activation code or registered account
• Is subject to LoveProof being commercially launched

We may take reasonable steps to prevent misuse, duplicate registrations or fraudulent claims.

13. Referral Rewards

Eligible Founding Members may earn additional free Premium access by referring new users to the LoveProof waitlist. For each qualifying referral who successfully completes the required waitlist registration and survey, the referring Founding Member may receive:

1 additional month of Unlimited Premium access.

Founding Members may earn a maximum of 12 months of free Premium access in total, consisting of:

• 3 months for qualifying as a Founding Member; and
• Up to 9 additional months through successful referrals.

A referral will only qualify where LoveProof can reasonably attribute the new registration to the referring member. Referral attribution may occur through:

• Unique referral links
• Referral codes
• Email addresses
• Mobile numbers
• Other tracking methods implemented by LoveProof

Self-referrals, duplicate registrations, fraudulent registrations, automated registrations or attempts to manipulate the referral program will not qualify. LoveProof reserves the right to investigate referral activity and remove rewards obtained through abuse or manipulation.

14. Referral Invitations

If you provide another person's email address or mobile number for the purpose of sending a LoveProof invitation, you confirm that you reasonably believe the person would be comfortable receiving that invitation. You must not use LoveProof's referral functionality to send unsolicited, repetitive, misleading or inappropriate communications.

15. Activation Codes

Founding Member and promotional activation codes may be unique to an individual account. You are responsible for keeping your activation code secure. LoveProof may refuse or cancel codes that:

• Have been obtained fraudulently
• Have been duplicated
• Have been sold or transferred contrary to these Terms
• Have been manipulated
• Have already been redeemed

16. Future Paid Subscriptions

LoveProof may offer paid subscriptions after launch. Subscription pricing, billing frequency, included features, cancellation arrangements and any trial periods will be clearly disclosed before you purchase a subscription. Any paid services will also be subject to applicable Australian consumer law. Where required by law, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

17. Changes to Features

LoveProof is an evolving technology product. Features shown during the waitlist, prototype or beta stages may change before commercial launch. We may add, remove, modify or discontinue features as the product develops. Images, demonstrations, prototypes and mock-ups displayed before launch are illustrative and may differ from the final product.

18. Intellectual Property

Unless otherwise stated, LoveProof owns or licenses the intellectual property associated with the Service, including:

• LoveProof branding
• LoveProof logo
• Trust Score™ branding
• Website design
• Software
• Algorithms
• User interface
• Written content
• Graphics
• Reports
• Product features

You may use LoveProof only for your personal, lawful use.

Nothing in these Terms transfers ownership of LoveProof intellectual property to you.

19. Your Content

You retain any rights you have in content you submit to LoveProof. You grant LoveProof a limited licence to process, analyse, transmit and temporarily reproduce submitted content to the extent reasonably necessary to provide, secure and improve the Service. Our handling of personal information is also governed by our Privacy Policy.

20. Privacy

Your privacy is important to us. Our collection, use and handling of personal information is described in the LoveProof Privacy Policy. By using LoveProof, you acknowledge that personal information may be handled in accordance with that policy.

21. Availability of the Service

We aim to provide a reliable service, but we do not guarantee that LoveProof will always be available or uninterrupted. The Service may occasionally be unavailable because of:

• Maintenance
• Technical failures
• Third-party outages
• Internet disruption
• Security incidents
• Product updates
• Events outside our reasonable control

22. Limitation of Liability

To the maximum extent permitted by law, LoveProof is not liable for loss or damage arising solely from a user's reliance on an automated assessment, Trust Score™, AI result or other indicator provided by the Service where that result is inaccurate or incomplete. LoveProof does not guarantee the behaviour, identity, intentions or safety of any person whose profile is analysed.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy available to you under the Australian Consumer Law or other applicable law that cannot lawfully be excluded, restricted or modified. Where our liability can lawfully be limited, it will be limited to the extent permitted by applicable law.

23. Indemnity

To the extent permitted by law, you are responsible for loss reasonably incurred by LoveProof resulting from your unlawful use of the Service, material breach of these Terms, or infringement of another person's rights. This provision does not apply to the extent that the relevant loss was caused or contributed to by LoveProof.

24. Suspension or Termination

We may suspend or terminate your access to LoveProof where we reasonably believe:

• You have materially breached these Terms
• You are using LoveProof unlawfully
• You are abusing another person through the Service
• You are manipulating our referral or promotional programs
• Your activity presents a security risk
• Suspension is reasonably necessary to protect LoveProof or other users

Where appropriate, we may provide notice or an opportunity to address the issue.

25. Changes to These Terms

LoveProof is currently under development. We may update these Terms as our product, technology, subscription model or legal obligations evolve. The latest version will be published on our website together with the date it was last updated. If we make material changes affecting existing users, we may provide additional notice where appropriate.

26. Governing Law

These Terms are governed by the laws applicable in New South Wales, Australia. Subject to any rights you may have under applicable consumer law, disputes relating to these Terms will be subject to the jurisdiction of the courts of New South Wales and applicable Commonwealth courts.
